Property and Land Law in Practice

Land is the asset most often transacted without anybody checking what is actually registered against it, which is how buyers acquire somebody else's servitude, mortgage or occupier. This course covers doing it properly. Delegates work through ownership and the registration system, the deeds search and what it does and does not reveal, and real rights including servitudes, usufruct and restrictive conditions. Sale agreements and suspensive conditions are covered, along with transfer, bond registration and the sequence of a conveyancing transaction. Leases and the rights of occupiers follow. Customary and communal tenure is addressed, since a great deal of African land sits outside the deeds system. The course closes on disputes and expropriation.
