Mediation and Arbitration in Practice

Litigation is slow, public and expensive enough that most commercial disputes should not reach it, and the alternatives fail when they are entered without understanding how each actually works. This course covers both. Delegates work through the dispute resolution options and how to choose between them, mediation process and the mediator's role, and preparing for and participating in a mediation including the authority to settle. Arbitration follows: the arbitration agreement, appointment, procedure and the extent to which parties control it. Awards, enforcement and the narrow grounds for challenge are covered. Multi tiered clauses and their pitfalls are addressed. The course closes on drafting a dispute resolution clause that will work when it is needed.
