Insolvency, Business Rescue and Creditor Rights

When a company runs out of money the law reorders every relationship around it, and the decisions taken in the weeks before that point determine both the outcome and whether directors face personal liability. This course covers that territory. Delegates work through the tests for insolvency and the duties that shift as it approaches, business rescue and the moratorium it imposes, and the practical mechanics of a rescue plan and its adoption. Liquidation follows, including the order of preference and the claims process. Security, retention of title and set off are covered from a creditor's point of view. The course closes on voidable transactions and on director liability for reckless trading.
